Project Administration Advice

Developing an effective procurement and contracting strategy is only part of what makes a project successful – effective project management and administration is a necessity.  Capital Project Strategies assists owners, contractors, designers, and other parties when they confront project execution challenges.  We offer a broad mix of technical, commercial, and legal support, all with the goal of finding a way to position the client for a successful, non-litigation resolution. 

We follow several guidelines in providing project administration advice.  First, our advice needs to be pragmatic and objective.  We feel that the lessons learned from our years of experience in litigating and arbitrating cases, as well as our broad industry experience in developing procurement and contracting approaches, help us formulate strategies that accomplish these goals.  Next, our advice needs to be given “real-time” – otherwise the opportunity for accomplishing a desired outcome may pass.  We recognize this need and staff appropriately.  Stated differently, if we cannot be available “on call” as needed to do well for our clients in project administration, we will not take on the assignment. 

Included among the substantive issues where we can provide assistance are:

  • Scope of work disputes
  • Failures in meeting performance specifications
  • Differing site conditions
  • Project delays
  • Lost efficiency and disruption claims
  • Forced and constructive accelerations
  • Design defects and liability
  • Terminations

We help clients prepare and defend claims in these areas, evaluate contractual requirements, and work with other technical consultants to develop the appropriate claim theory or defense.  We also pay a great deal of attention to project controls – helping our clients and their project teams use these controls for effective project management through trend reports and forensic scheduling tools. 

It should be noted that we do not attempt to replicate the work that will be done by the client’s litigation team or forensic consultants.  Rather, we augment the team by providing it with “high level, strategic” advice.  On some occasions, our work will be quite limited, and may only entail developing the claims defense/prosecution strategy, leaving it to others to implement the strategy.  This might be the case in a decision to terminate a contractor, where our advice would involve helping the owner decide among terminations for default or convenience options.  On other occasions, clients will have us analyze the entire situation, draft key project correspondence, and provide detailed “path forward” assessments.  In these situations, we may team with others (e.g., scheduling consultants) to meet the client’s needs for support.
